Being charged with a crime can be a life-changing event. Often, the first thing that happens is a warrant is issued for your arrest, which can result in time spent in jail at the outset of the case. In state court, you will most likely be eligible for bail, which is an amount of money paid to the court that allows you to remain in the community while your case is pending. In federal court, a magistrate judge will decide if you will be detained pending trial or released to pretrial services. Thereafter, you will be charged by one of several means – usually by way of Indictment or Complaint, and you may be entitled to a preliminary hearing. Once you enter a plea of not guilty, the state has a certain amount of time (known as Speedy Trial) to either try or otherwise resolve your case. Many different factors impact that timeline, and cases may take many months or even years to resolve. Of course, there are many steps along the way that may impact the outcome of your case.
